1. General Provisions

The e-commerce website of Le Chef Gastronome, a sole proprietorship with its registered office at Brialmontlei 21, 2018 Antwerp, Belgium, VAT BE 0798 548 738, offers its customers the possibility to purchase products from its online store.

These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website (“Customer”). By placing an order through the web store of www.lechefgastronome.com, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously accepted in writing and expressly by Le Chef Gastronome.

 

 2. Price

All prices listed are in EURO, always including VAT and all other taxes or charges required to be borne by the Customer.

If delivery, reservation, or administrative fees are charged, this will be stated separately.

The price statement refers exclusively to the articles as described. The accompanying photos are intended for decorative purposes and may include elements that are not included in the price.

 3. Offer

Despite the fact that the online catalog and e-commerce website are compiled with the utmost care, it is possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Le Chef Gastronome. Le Chef Gastronome is only committed to a means obligation concerning the accuracy and completeness of the offered information. Le Chef Gastronome is in no case liable in case of manifest material errors, typographical or printing errors, nor the website creator GB PRO.

If the Customer has specific questions about quantity, color, availability, delivery time, or method of delivery, we request the Customer to contact our customer service in advance.

The offer is valid while stocks last and can be adjusted or withdrawn by Le Chef Gastronome at any time. Le Chef Gastronome cannot be held liable for the unavailability of a product. If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.

 4. Online Purchases

When you visit our website and select our products, you are redirected to the form page where you must fill in all required information and send it to the supplier. Once Le Chef Gastronome receives the quote, it is processed by the administrator. After the quote is drafted by Le Chef Gastronome, it is sent to the customer. The customer can then decide to accept or reject the quote. If you as a buyer want to draw up a contract before or after accepting the quote, you must always discuss this with Le Chef Gastronome and put it in writing. After the contract is signed and all details are discussed, payment takes place. Le Chef Gastronome is entitled to refuse an order following a serious shortcoming of the Customer concerning orders in which the Customer is involved.

5. Delivery and Execution of the Agreement

The agreement between Le Chef Gastronome and you as a customer must be drawn up in writing and read and approved by both parties. The delivery of the products occurs exclusively with transport that has cooling facilities, or for smaller quantities, a cool box can also be applied. The transport service is chosen by Le Chef Gastronome, or Le Chef Gastronome can transport goods itself, unless the customer desires otherwise and gets approval from Le Chef Gastronome for an alternative. If the transport is in good condition when sent but arrives damaged at the customer's location, Le Chef Gastronome is not directly liable for the damage, but the transport company is if different from Le Chef Gastronome. If the goods are delivered to the transport company at the agreed time but do not arrive on time at the customer, Le Chef Gastronome is not liable; the liability lies with the transport company. The delivery term is fixed in the contracts between Le Chef Gastronome, the customer, and the transport company. Le Chef Gastronome can deliver goods to all European countries, the United Kingdom, and Switzerland, if the customer accepts the quote. Quotes are always offered including import costs, unless otherwise determined on the quote or invoice. The delivery occurs with transport that has cooling facilities or with a cool box, unless otherwise determined by the customer. Unless otherwise agreed or expressly determined, the goods will be delivered to the customer's home address within 30 days after receipt of the agreed price.

Any visible damage and/or qualitative deficiency of an article or other deficiency upon delivery must be reported immediately by the Customer to Le Chef Gastronome and the Transport Company that is liable for the transport at that time.

The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically received the goods. However, the risk already transfers to the Customer upon delivery to the carrier, if the carrier of the Customer has been tasked to transport the goods and this choice was not offered by Le Chef Gastronome.

6. Retention of Title

The delivered articles remain the exclusive property of Le Chef Gastronome until full payment by the Customer. The Customer undertakes to inform third parties of Le Chef Gastronome's retention of title if necessary, e.g., to anyone who would seize the articles that have not yet been fully paid for.

7. Right of Withdrawal

The provisions of this article apply only to Customers who purchase articles online from Le Chef Gastronome in their capacity as consumers.

If the right of withdrawal is applicable:

The Customer may not exercise the right of withdrawal for:

service agreements after the complete execution of the service [if the execution has begun with the explicit prior consent of the Customer, and provided the Customer has acknowledged that he loses his right of withdrawal as soon as the agreement is fully executed]; the delivery or provision of goods or services whose price is tied to fluctuations in the financial market over which Le Chef Gastronome has no influence and which can occur within the withdrawal period; the delivery of goods made to the Customer's specifications, or clearly personalized; the delivery of goods that can spoil quickly or have a limited shelf life; the delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery; the delivery of goods that by their nature are irrevocably mixed with other products after delivery; the delivery of alcoholic beverages whose price was agreed upon at the conclusion of the sales agreement, but whose delivery can only take place after 30 days, and whose real value depends on market fluctuations over which the company has no influence; agreements where the Customer has specifically requested a visit to carry out urgent repairs or maintenance; the delivery of sealed audio and sealed video recordings and sealed computer software whose seal has been broken after delivery; the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts for such publications; agreements concluded during a public auction; the provision of accommodation other than for residential purposes, goods transport, car rental services, catering, and services related to leisure activities, if the agreements provide for a specific date or period of performance; the delivery of digital content not supplied on a tangible medium, if the execution has begun with the explicit prior consent of the Customer and provided the Customer has acknowledged that he thereby loses his right of withdrawal (e.g., downloading music, software); agreements for services for betting and lotteries.

8: Warranty

Under the law of September 21, 2004, on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This statutory warranty applies from the date of delivery to the first owner. Any commercial warranty leaves these rights unaffected. To invoke the warranty, the Customer must be able to present a proof of purchase. Customers are advised to keep the original packaging of the goods.

For items that were purchased online and delivered to the Customer's home, the Customer must contact the Le Chef Gastronome Customer Service and return the article at his expense to Le Chef Gastronome.

Upon the detection of a defect, the Customer must inform Le Chef Gastronome as soon as possible. In any case, any defect must be reported immediately upon receipt to Le Chef Gastronome and the transport company. Afterwards, any right to repair or replacement expires.

The (commercial and/or legal) warranty is never applicable to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest after the starting period, possibly delivery, are presumed not to be hidden defects, unless proven otherwise by the Customer.

10. Sanctions for Non-payment

Without prejudice to the exercise of other rights that Le Chef Gastronome possesses, the Customer owes an interest of 10% per year on the amount unpaid from the date of non-performance by operation of law and without warning. Furthermore, the Customer is legally and without warning liable to pay a fixed compensation of 10% on the amount involved, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Le Chef Gastronome reserves the right to take back the not (fully) paid articles.

11. Privacy

The controller, Le Chef Gastronome, respects the Belgian law of December 8, 1992, regarding the protection of privacy in the processing of personal data.

The personal data provided by you will only be used for the following purposes: the execution of the concluded agreement, the processing of the order, sending newsletters, advertising, and/or marketing purposes.

You have a legal right to inspect and possibly correct your personal data. With proof of identity (copy of identity card), you can obtain a written notification of your personal data free of charge via a written, dated, and signed request to Le Chef Gastronome, info@lechefgastronome.com, Brialmontlei 21, 2018 Antwerp, Belgium. If necessary, you can also ask to correct the data that would be incorrect, incomplete, or irrelevant.

In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. Failure at any time by Le Chef Gastronome to enforce any of the rights listed in these Terms, or to exercise any right hereunder, will never be seen as a waiver of such provision and will never affect the validity of these rights.

 14. Amendment of Conditions

These Terms are supplemented by other conditions explicitly referred to, and the general sales conditions of Le Chef Gastronome. In case of conflict, these Terms prevail.

15. Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

16. Applicable Law – Disputes

Belgian law applies, with the exclusion of provisions of international private law concerning applicable law.

The courts of the domicile of the Consumer have jurisdiction in judicial disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
